Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and the operator of Ovid ("Ovid", "we", "us", "our"), governing your use of the Ovid platform and services accessible at https://ovid.art (the "Service").

This Service is strictly for adults (18+). By accessing or using the Service, you represent that you are at least 18 years of age and agree to be bound by these Terms, our Acceptable Use Policy, and our Privacy Policy. If you do not agree, you must not use the Service.

2. Definitions

  • AI-Generated Content: any image or visual output produced by the Service's AI models.
  • Muse: a synthetic, AI-generated subject cast and managed by the Service. A Muse is not a real person and does not depict one.
  • Generation: a single instance of AI-Generated Content produced by the Service.
  • Non-Consensual Intimate Imagery (NCII): any intimate or sexual depiction of an identifiable person created or distributed without their consent, including AI-generated imagery.
  • Minor: any person under 18 years of age.
  • Pack: a curated set of AI-generated frames of a single Muse, sold as a unit.

3. Service Description

Ovid uses artificial intelligence to generate editorial and sensual portrait imagery. Every image depicts a Muse — a synthetic subject cast and managed by the Service. The Service operates in two modes:

  • Curated Feed: a gallery of AI-generated images of synthetic, fictional subjects in an editorial register. No real person is depicted.
  • Packs: on purchase, the Service generates a set of frames of the pack's Muse in that pack's editorial frame and delivers them to your gallery.

The Service offers no upload surface: you cannot submit photographs, faces, or any other imagery. All AI-Generated Content depicts synthetic, fictional subjects. No image produced by the Service depicts a real person, a real event, or a real scene.

4. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this requirement. Entry to the Service is conditioned on an explicit acknowledgment that you are 18 or older (or the age of majority where you live). We reserve the right to request proof of age and to terminate accounts where we have reason to believe a User is under 18. Access by minors is strictly prohibited.

5. Accounts and Payment

5.1 Account Creation. Certain features require account registration. You must provide accurate information and maintain its accuracy. You are responsible for all activity under your account.

5.2 Packs. Packs are purchased on a one-time basis. Prices are displayed inclusive of applicable taxes.

5.3 No Refund on Policy Violation. Access forfeited due to account termination for policy violations is non-refundable. For other refund requests, contact contact@ovid.art.

6. User Representations and Warranties

By using the Service, you represent and warrant that:

  1. Age. You are at least 18 years old.
  2. Legal Compliance. Your use complies with all applicable laws, including French law, EU regulations (AI Act, GDPR), and the laws of your jurisdiction.
  3. No Misuse. You will not use outputs to deceive, harass, defame, threaten, or harm any person, and you will not present any output as depicting a real person or a real event.

7. Acceptable Use Policy

The full Acceptable Use Policy is incorporated herein by reference. By using the Service, you agree to comply with it in its entirety.

8. Content Moderation

8.1 We run background checks to detect non-compliant content. Content that violates our policies may be removed, and the associated account may be suspended or terminated.

8.2 We reserve the right to review, remove, or restrict access to any content at our discretion, and to cooperate with law enforcement where required.

9. Intellectual Property and Ownership

9.1 Pack Content. Subject to compliance with these Terms and applicable law, your purchase grants you a perpetual, non-exclusive license to use the images delivered to your gallery for personal, non-commercial purposes. Commercial use requires separate authorization — contact contact@ovid.art.

9.2 Platform IP. All rights in the Service, its design, models, code, and branding remain the exclusive property of Ovid.

10. Data Processing and Storage

10.1 Processing. The Service processes account and payment data as described in our Privacy Policy. Image generation runs on servers in the European Union (Frankfurt, Germany), and generated images are stored on encrypted servers in the same region.

10.2 No Biometric Data. The Service has no upload surface and processes no photographs and no biometric data of its Users.

10.3 GDPR. Processing of personal data is subject to the General Data Protection Regulation (EU) 2016/679, as detailed in our Privacy Policy.

10.4 Likeness Review. Any person who believes an AI-Generated image resembles them may request review and removal under Article 17 GDPR by contacting contact@ovid.art. See our Content Removal Policy.

11. Limitation of Liability

11.1 The Service is provided "as is" and "as available", without warranty of any kind, express or implied.

11.2 To the maximum extent permitted by applicable law — and subject to mandatory provisions of French consumer law — Ovid shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service.

11.3 Aggregate liability. Our total aggregate liability to you shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ovid, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or costs arising from: your use of the Service; your breach of these Terms; your violation of any third-party rights; any AI-Generated Content produced from your inputs; or your violation of any applicable law.

13. Cooperation with Authorities

Ovid cooperates fully with French and EU law enforcement in accordance with applicable law. We respond to valid legal process within required timeframes. Where legally required or permitted, we report illegal content — including CSAM — to PHAROS, NCMEC if applicable, and Europol/EC3 as appropriate. Upon receipt of a valid preservation request, relevant data is preserved for a minimum of 90 days.

14. Termination

14.1 By User. You may terminate your account at any time. Unused pack entitlements are non-refundable upon voluntary termination.

14.2 By Us. We may suspend or terminate your account at any time, with or without notice, for breach of these Terms or the Acceptable Use Policy. In cases involving illegal content, termination is immediate.

14.3 Effect. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature survive termination (liability, indemnification, data retention, intellectual property) shall survive.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France, subject to mandatory consumer protection provisions that may grant jurisdiction to the courts of your domicile.

For Users within the European Union, you may also submit disputes to the EU Online Dispute Resolution platform.

16. Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated via your account email or by notice on the Service at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of Ovid's AI image generation service. It is incorporated into and forms part of the Terms of Service. Violation may result in immediate account termination and reporting to authorities.

Allowed

  • View and save AI-generated images from the curated feed
  • Purchase packs and receive AI-generated frames of the pack's muse
  • Use delivered content for personal, non-commercial purposes

Prohibited — enforcement is immediate

  • Any content involving minors (under 18) — absolute prohibition
  • Attempting to introduce a real person's likeness into generation
  • Using outputs to harass, bully, defame, or threaten any person
  • Presenting outputs as depicting a real person or a real event
  • Impersonation or identity fraud
  • Content promoting violence, hatred, or illegal activity

1. Purpose

This Policy exists to prevent harm. Ovid is a synthetic-only service by architecture: there is no upload surface, and every image depicts a Muse cast and managed by the Service — no User input introduces a real person's likeness. This architecture is the primary safeguard against non-consensual intimate imagery (NCII). The rules below reinforce it.

2. Prohibited Content

You may NOT upload, generate, or cause to be generated any content that includes, depicts, or facilitates:

2.1 Child Sexual Abuse Material (CSAM)

Any sexual, nude, or suggestive content involving or appearing to involve minors. This is absolute. It includes AI-generated, cartoon, stylized, or simulated depictions. There is no exception, no edge case, no ambiguity.

Zero tolerance. Immediate report to authorities.

2.2 Non-Consensual Intimate Imagery (NCII)

Any intimate, sexual, or nude imagery of an identifiable real person created or shared without their explicit consent. This includes:

  • Any attempt to cause the Service to render a real, recognizable person in a sexual or nude context without their explicit authorization
  • Synthetic deepfake imagery of any kind involving a non-consenting subject

Under French law (Article 226-8-1 du Code pénal, loi du 19 février 2024), creating a deepfake of a sexual nature without consent is a criminal offense punishable by up to 2 years imprisonment and EUR 60,000 fine (3 years and EUR 75,000 when distributed online). The US TAKE IT DOWN Act (signed May 2025) criminalises NCII federally. These are not risk factors — they are the law.

2.3 Circumventing the Synthetic-Only Architecture

The Service offers no facility to upload or submit imagery. Any attempt to introduce a real person's likeness into the generation pipeline — by circumventing technical restrictions or otherwise — is prohibited regardless of context or claimed consent, and may violate applicable law.

2.4 Harassment and Defamation

Content created to harass, bully, intimidate, threaten, or defame any person — including placing a person's face in humiliating or degrading contexts, creating images to damage someone's reputation, or targeted campaigns using generated images.

2.5 Violence, Hate Speech, and Illegal Activities

Content depicting realistic violence, mutilation, or graphic injury. Content promoting hatred or discrimination based on any protected characteristic. Content facilitating fraud, impersonation, terrorism, or any activity prohibited by applicable law.

3. Your Responsibilities

By using Ovid, you represent and warrant that:

  1. You are at least 18 years old.
  2. You will not attempt to introduce any real person's likeness — your own or a third party's — into the generation pipeline.
  3. You will not use generated content to harm, deceive, or mislead any person.
  4. You accept sole responsibility for your use and distribution of content delivered to you, including legal liability.

4. Enforcement and Consequences

Critical

CSAM: Account suspended immediately. Data preserved. Report filed with PHAROS and NCMEC.

NCII: Content removed. Account suspended pending review. Report filed where legally required.

High

Attempts to introduce a real person's likeness into generation. Violent or hateful use of outputs. Same-day action.

Standard

First offense: warning and content removal. Second: account suspension. Third: permanent termination, access forfeited.

In all cases: non-compliant content may be removed, we cooperate fully with law enforcement, and forfeited access is non-refundable.

5. Reporting Violations

If you encounter content that violates this Policy, or if your likeness has been used without consent, contact us immediately at contact@ovid.art with subject line: [ABUSE REPORT] — Brief description.

Reports involving CSAM are escalated immediately to law enforcement.

Non-Consensual Intimate Imagery (NCII) Policy

Why This Policy Exists

Ovid generates sensual and adult imagery. While the Service is architected so that no real person's likeness enters generation, the nature of the product requires clear, specific commitments on NCII. We recognize NCII as one of the most serious forms of technology-facilitated abuse and have adopted specific safeguards.

Definition

Non-Consensual Intimate Imagery (NCII) includes any intimate, sexual, or nude image of an identifiable person that is created without their explicit consent (whether AI-generated, manipulated, or synthetic), or distributed without their explicit consent even if originally created with consent.

The harm is in the non-consent, not in the realism of the image.

NCII is illegal in France, the EU, the UK, and the United States:

  • France, Article 226-8-1 du Code pénal (loi du 19 février 2024): creating an AI-generated deepfake of a sexual nature without consent is punishable by up to 2 years imprisonment and EUR 60,000 fine (3 years / EUR 75,000 when published online).
  • US TAKE IT DOWN Act (signed May 2025): criminalises publishing non-consensual intimate depictions of real persons, expressly including AI "digital forgeries." Penalties up to 3 years.
  • UK Sexual Offences Act 2003 s.66E–66F (in force Feb 2026): criminalises the creation and request of non-consensual intimate deepfakes.
  • EU AI Act Art. 50 (applies Aug 2026): requires machine-readable labelling of AI-generated content.
  • GDPR, Article 9: processing of biometric data (face recognition) requires explicit consent.

Our Safeguards

Ovid's primary safeguard is architectural: the Service has no upload surface, every image depicts a synthetic Muse cast and managed by the Service, and no User input introduces a real person's likeness. We additionally employ automated measures to detect and address non-compliant content. Content that violates our policies may be removed at any time.

If You Are a Victim

If your likeness has been used on Ovid without your consent to create intimate or sexual imagery:

  1. Contact us immediately at contact@ovid.art with subject line: [NCII REMOVAL REQUEST].
  2. Provide: your name and contact information, a description of the content (you do not need to provide the image itself), any URL or identifier that helps us locate it, and a statement that the content depicts you and was created without your consent.
  3. What we will do: acknowledge your request promptly, investigate and locate the content, remove it and flag associated accounts, preserve evidence for law enforcement, and confirm removal to you.

We strongly encourage you to also file a complaint with:

  • PHAROS (French online content reporting platform)
  • Your local police — this is a criminal offense in France and the UK
  • StopNCII.org for hash-based removal across participating platforms

Content Removal & Takedown Process

  • Any person whose likeness appears in AI-Generated Content without their consent
  • Rights holders for intellectual property infringement
  • Legal representatives acting on behalf of any of the above
  • Law enforcement authorities pursuant to valid legal process

How to Submit a Removal Request

Email contact@ovid.art with subject line: [REMOVAL REQUEST] — Type (NCII / Likeness / Copyright / Other).

Include:

  1. Your identity: Full name, contact email, relationship to the content.
  2. Content identification: URL, generation ID, screenshot, description, approximate date, account info if known.
  3. Basis for removal: Likeness used without consent, NCII, intellectual property infringement, or other.
  4. Declaration: A signed statement confirming the content depicts your likeness (or the likeness of the person you represent) and was created or distributed without consent.

What Happens After Removal

  1. Content is removed

Appeals

If your content was removed or your account was actioned and you believe this was an error, email contact@ovid.art with subject line: [APPEAL] — Account/Content ID. Appeals are reviewed within a reasonable timeframe. The decision on appeal is final.
